National Labor Relations Board Posting Rule Delayed for the Second Time

As we previously reported, the National Labor Relations Board (“NLRB”) issued a new rule requiring all private sector employers within its jurisdiction to post a notice informing employees of their rights under the National Labor Relations Act (“NLRA”). The rule affects most private sector employers regardless of whether or not their employees are represented by a union. The rule was originally scheduled to take effect on November 14, 2011 and was subsequently postponed to January 31, 2012.
The NLRB has again postponed the implementation date of the rule, this time to April 30, 2012. According to the NLRB, it agreed to postpone the effective date of the rule at the request of the federal court in Washington, D.C. that is hearing one of several legal challenges regarding the rule. The NLRB determined that postponing the effective date of the rule would facilitate the resolution of the legal challenges that have been filed with respect to the rule.
