Transportation
Recognizing complexities associated with the movement of goods, both nationally and internationally, Posternak has brought together attorneys with expertise in transportation law, corporate and tax law, as well as international trade, to form its Transportation Group, representing shippers and receivers of freight such as shippers associations, manufacturers, distributors and retailers as well as transportation service providers, including carriers, customs brokers, freight forwarders, warehouse operators and both asset based and non-asset based logistics service providers.
We provide a full range of legal services including:
- Assisting both carriers and shippers in the negotiation and drafting of underlying transportation agreements including truck load and less than truck load agreements, container and less than container load agreements, intermodal contracts, and ocean carrier agreements.
- Representing clients in connection with the preparation of ancillary transportation agreements including freight auditing and payment service agreements, property brokerage, warehousing, logistics and freight forwarder agreements, as well as equipment acquisition, financing and leasing.
- Counseling clients concerning cargo loss and damage claims including the assessment, prosecution and/or defense of OS&D claims, including claims subject to international conventions as well as COGSA and related federal legislation.
- Protecting client interests in the context of national and international bankruptcy proceedings.
- Liability assessment, counseling and representation, reviewing contract terms and conditions, bills of lading, house and air waybills and insurance coverage, as well as representing clients before federal and state courts and regulatory authorities.
- Counseling clients in export and customs matters, including the International Traffic in Arms Regulations and the Export Administration Regulations.
- Reviewing and developing programs pertaining to hiring and qualification of drivers, motor carrier safety including hours of service compliance and training.
- Assisting businesses in labor and employment matters including drafting owner operator leases, counseling regarding independent contractor status, workers compensation coverage, wrongful discharge and discrimination claims.
- Environmental review and HAZMAT compliance.
