Domestic Relations
Posternak has a sophisticated domestic relations practice, representing clients in all areas of family law including pre-marital agreements to separation and divorce actions, property division, custody and visitation disputes, modifications and contempt proceedings. We litigate matters in all probate and family courts in Massachusetts, and are experienced in representing clients in alternative dispute resolution (including mediation and conciliation). Our attorneys have earned a deserved reputation for being both tough-minded and fair advocates providing effective representation of their clients’ interests, and responding to each individual’s unique set of circumstances.
Our attorneys work efficiently and effectively to obtain court orders and judgments to protect our clients’ interests in divorce, modification and other Probate Court proceedings, including for example, alimony, custody and visitation, child support, and preservation and division of marital assets, or modifying existing support and custody orders. Whether in negotiations or at trial, we bring the ability to analyze and value the myriad of financial assets often at stake, including complex compensation plans, business interests, trusts, stock options, pension and profit sharing plans and other financial investments, as well as the tax consequences of both dividing assets and setting support obligations. We work closely with the firm’s corporate, real estate, trust and estates, and tax attorneys, and, when necessary, we consult with other outside experts, including licensed mental health professionals, closely-held business valuation experts, and certified real estate appraisers.
Domestic relations clients benefit from our attorneys’ extensive experience in resolving the most contentious disputes. Because we know that each client’s circumstances are unique, we focus on developing the right strategy to create a successful resolution tailored to the specific needs of each client and each case. Our attorneys are experienced in the negotiation and mediation of family law matters, and we are frequently able to resolve a family law dispute without the expense of a trial. If litigation proves to be the most effective strategy, we have the experience and the access to expert witnesses to represent clients in all areas of family law litigation, from emotionally charged divorces and child custody disputes to complex property division cases.
