Real Estate Development & Operation
The firm’s real estate practice is broadly based, both as to types of matters dealt with and geographical location of properties. We represent clients from as far as Europe and Asia in all aspects of real estate development and operation, including matters regarding acquisition and disposition of both vacant and developed parcels, permitting, environmental issues, construction and permanent financing, tax planning, condominium conversion, leasing for all types of commercial, retail and industrial real estate uses and establishment of entities such as joint ventures and limited liability companies to hold title to and operate the property.
Negotiation of agreements
We handle all legal matters arising in our clients’ businesses. We negotiate and draft purchase and sale agreements, construction contracts, leases, mortgage loan commitments and loan documents with lenders as diverse as banks, CMBS lenders, insurance companies and pension funds. We take pride in our ability to find solutions which both protect our clients and allow them to “make the deal” in a timely and profitable manner.
Our expertise in client advocacy results in success in obtaining zoning, environmental and other governmental permits and approvals required in order to move projects forward. Our experience allows us to mount the best possible defense when appeals are taken from permits and approvals granted to our clients.
We are experienced in working closely with architects, land planners, engineers, and other professionals to ensure that our clients’ projects comply with the myriad of state and federal laws, local building codes and other land use regulations. We also review the work product produced by such professionals to assist our clients in presentation of results in a positive manner.
When issues such as appeals from zoning decisions, municipal real estate tax assessments and mortgage work-outs and foreclosures arise which cannot be handled by negotiation, our expertise in litigation allows us to represent our clients’ interests in court and administrative proceedings, as well as before arbitrators and mediators.
